By accessing or using Microbix's products, services, APIs, and software ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Services.
You must provide accurate information when creating a Microbix account and are responsible for keeping your API keys and login credentials secure. You are responsible for all activities that occur under your account.
Subject to these Terms, Microbix grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services. You agree not to use the Services in a manner that exceeds the scope of this license.
You agree not to engage in any of the following prohibited activities:
Paid plans are billed in advance on a monthly or annual cycle. Usage is metered using mX credits. mX credit usage beyond your plan allotment is billed at the standard overage rate shown in your dashboard.
All fees are non-refundable, except as required by law. You are responsible for any applicable taxes associated with your use of the Services.
Microbix retains all right, title, and interest in and to the Services, including all underlying technology, algorithms, and intellectual property. Nothing in these Terms transfers any intellectual property rights to you.
You retain ownership of any data, prompts, or content you submit to the Services ("User Content"). You grant Microbix a worldwide, royalty-free license to use, host, and process User Content solely for the purpose of providing the Services to you.
If you use our APIs or CLI tools, you must comply with all provided documentation and rate limits. Microbix reserves the right to modify or deprecate APIs with reasonable notice. We may suspend API access if we detect abuse or excessive usage.
We strive to ensure high availability of our Services, subject to our Service Level Agreement (SLA) for Enterprise tier customers. For non-Enterprise users, Services are provided on a reasonable-efforts basis without a guaranteed SLA.
Microbix products are provided "as is." Microbix Labs Inc. is not liable for indirect, incidental, special, or consequential damages arising from the use of the service, to the maximum extent permitted by law. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Microbix, its affiliates, and their respective officers, directors, and employees from any claims, damages, liabilities, costs, and expenses arising out of your use of the Services or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in Hyderabad, India.
We may suspend or terminate accounts that violate these Terms. You may cancel your account at any time from your account settings; no partial-period refunds are issued for cancellations mid-cycle.
